Can I Make A Motion To Dismiss A Complaint If The Attorney Hasn’t Served Me?

A debt collector filed a lawsuit against me. I contacted him several times by letter asking for a copy of the complaint and summons and he has not responded. I was afraid he might try to move for a default against me if I didn’t answer so I went to the Court and obtained a copy and I also filed an answer. Can I still move to dismiss the complaint if he hasn’t actually served me?

If you already filed your answer, you will not be permitted to file this motion. You would have had to file it prior to any other filings on your behalf or else you have waived it.
It’s immaterial at this point if you get served, since went to the court house accepted the complaint and submitted an answer so the ball is rolling so to speak, if you wish you can file a motion to dismiss at this point, but without knowing all the facts, not sure why the court would grant the motion
You would have to ask your question to a judge. They can answer better than anybody here could.
Dan, news flash…women do NOT like “projects”. We are sick of “projects” and yes, I personally would definitely run from a guy who timidly told me he hasn’t had a girlfriend in 8 years. There are usually some problems there under the surface that I just no longer need the drama of.

Normally Court Appointed Attorney has more to do with ones inability to afford legal counsel. If the new husband is well off or even has a middle class income they would no longer qualify for free legal counsel.
Keep in mind the old saying… A person representing themselves in court has a fool for an attorney!
