Our Motion For A New Trial Has Been Denied Due To Lack Of Information, What Can We Do?
My attorney filed a bare-bones motion and asked for additional time to supplement the motion with authority, and bring in new information. The federal judge denies the motion for a new trial without the attorney supplementing the information for the bare-bones motion. The attorney told us we have until the end of the year, but he misled us again, even though I told him we have new discovered evidence.
Can we appeal the decision to get a new trial? What else can we do? Is there any hope for a new motion?

You can always appeal a decision especially if you have new evidence. What the problem seems to be here is your attorney. He has to be the one to file for a new motion with supporting evidence. My suggestion is either submit to the courts that you want to file a new motion pending dismissal of your current attorney in lieu of getting a new one. They may give you a time limit to do so. The court system is very complicated if you don’t know the rules. If there is a free legal service in your state or county consult with then for advice on this matter.
A good example is The Sixth Sense: it’s a recycled Twilight Zone episode but the combination of the director (at the time) and the actors totally sold it. I would say that The Usual Suspects falls into the same category. On the other hand, Bruce Joel Rubin’s Brainstorm was an excellent script that was destroyed by Douglas Trumbull’s bad direction and the bad performances that followed. Yet Rubin’s Jacob’s Ladder was an awesome script made into an awesome movie by an awesome director with awesome acting… and nothing.
